Interim Guidance for Businesses and Employers

Healthy employees are crucial to your business. Here are 10 ways to help them stay healthy.
Coronavirus disease 2019 (COVID-19) is a respiratory illness that can spread from person to person. It spreads between people who are in close contact with one another (within about 6 feet) and through respiratory droplets produced when an infected person coughs or sneezes. Symptoms can include fever, cough, or difficulty breathing, which may appear 2-14 days after exposure.
These steps are recommended to protect employees and prepare your business for disruption:
Identify a workplace coordinator who will be responsible for COVID-19 issues and their impact at the workplace.
Examine policies for leave, telework, and employee compensation.
- Leave policies should be flexible and non-punitive, and allow sick employees to stay home and away from co-workers. Leave policies should also account for employees who need to stay home with their children if there are school or childcare closures, or to care for sick family members.
- When possible, use flexible worksites (e.g., telework) and flexible work hours (e.g., staggered shifts) to help establish policies and practices for social distancing (maintaining distance of approximately 6 feet or 2 meters) between employees and others, especially if social distancing is recommended by state and local health authorities.
Review your leave policies with all employees and provide information about available employee assistance services. Share information on steps they can take to protect themselves at work and at home.
Identify essential employees and business functions, and other critical inputs such as raw materials, suppliers, subcontractor services/products, and logistics required to maintain business operations. Explore ways you can continue business operations if there are disruptions.
Prepare business continuity plans for significant absenteeism, supply chain disruptions, or changes in the way you need to conduct business.
Establish an emergency communications plan. Identify key contacts (with back-ups), chain of communications (including suppliers and customers), and processes for tracking and communicating about business and employee status.
Share your response plans with employees and clearly communicate expectations. It is important to let employees know plans and expectations if COVID-19 occurs in communities where you have a workplace.[/vc_column_text][/vc_column][vc_column]

The following Businesses, Services, and Activities are authorized to operate:
- Bowling alleys and food concession sales provided:
- Face masks are worn at all times by customers (and employees), except when actively eating and drinking;
- The food concession shall adhere to DPHSS Guidance Memo 2021-07 (REV 1);
- Barriers between employees and customers are provided at service counter or point of sale; and
- A written record is maintained by the establishment, which provides the following information that must be readily available to DPHSS, when requested:
- Date and time of the visit of every customer;
- Name of customer(s);
- Customer’s seating area;
- Number of customers in each bowling lane; and
- Phone and/or email of every customer.
- Child Care Facilities; provided, they adhere to DPHSS Guidance Memorandum 2020-20 and DPHSS’ “Rules and Regulations Governing Child Care Facilities.”
- Congregation of people, but shall be limited to no more than one-hundred (100) people, and they all maintain social distancing of not less than 6 feet from any other individual, unless they are of Immediate Family Unit or from Single Household Unit, and all wear face masks, unless unable to do pursuant to the U.S. Centers for Disease Control and Prevention guidance or as provided in applicable DPHSS guidance.
- Cosmetology Establishment; provided:
- It utilizes separate rooms for each customer, or workstations that are at least 6 feet apart;
- The employee servicing the customer wears a face mask and a face shield;
- The establishment complies with DPHSS Guidance Memorandum 2020-26;
- A written record is maintained by the establishment, which provides the following information that must be readily available to DPHSS, when requested:
- Date and time of the visit of every customer;
- Name of customer;
- Assigned staff and table or workstation; and
- Customer’s phone and/or email.
- Government of Guam Departments and Agencies.
- Government of Guam Departments and Agencies are operational, including those making accommodations for walk-in services, that emphasize on customer facing services; provided, such offices are able to adequately protect their employees and the public through the implementation of COVID-19 mitigation measures provided by DPHSS Guidance Memorandum 2020-28 (Minimum Requirements for Government of Guam).
- Work of Government of Guam social workers and other human services personnel who are authorized to conduct home visitations for the purpose of ensuring that social, educational, and human services are properly provided to for the members of the community; and that
- In as much as possible, there is no direct physical contact between the social workers/human services personnel and the client(s);
- Social workers/human services personnel properly wash their hands or use approved hand sanitizers prior to the start, and after each home visit, and after the home visit;
- Social distancing of not less than 6 feet is maintained; and
- Face masks are worn at all times by the GovGuam worker.
- Gymnasiums, fitness centers, and dance studios, and its locker and shower rooms at 75% of the room’s occupancy load; provided, the businesses:
- Thoroughly clean and disinfect, at least once a day, its handwashing sinks, toilets, and shower facilities;
- Adhere to DPHSS Guidance Memorandum 2020-16 (Minimum Requirements for Operations of Gymnasiums and Fitness Centers), including 6 feet distancing, with the exception on the use of locker and shower rooms;
- There is no contact amongst the participants;
- Non-participants (i.e., instructors, employees, and parents) must wear face mask; and
- All participants must wear face masks when not actively engaged in physical activity.
- Hotels will be allowed to continue limited operations pursuant to the latest DPHSS Guidance Memoranda to allow their guests to stay in their facilities.
- Indoor Dining in an Eating and Drinking Establishment; provided, it is limited to 75% of the occupancy load with no more than ten (10) persons per table per party, and each party is at least six (6) feet away from the other party.
- In-person instruction for all educational institutions, including public and private K-12 schools, colleges, and universities and those staff not engaged in distance learning or not performing critical functions is authorized; provided the following are implemented:
- Adherence to DPHSS Guidance Memorandum 2021-02 (Minimum Requirements for In-Class Operations of K-12 Schools and Institutions of Higher Education) and DPHSS Guidance Memorandum 2021-09 (Additional Guidance Relative to Adopting 3 Feet Social Distancing for In-Class Operations for K-12 Schools) and any additional requirements as DPHSS deems necessary.
- Distance learning by schools and its supporting activities is authorized, which include curb-side pick-up, delivery of materials and documents, and teachers utilizing their classrooms to conduct virtual classes.
- In-person instruction guidelines and protocols are approved for the re-opening of schools.
- Live Entertainment with the following requirements:
- In a bar or a tavern, all live entertainment at bars and taverns must meet the 6 feet distance requirements between the entertainer(s) and customers;
- All performers are strongly recommended to be 6 feet apart from one another in all directions;
- Face masks must be worn by all performers at all times, except for those who are actively singing, in which case physical barriers may be used where the top horizontal edge height of physical barrier (i.e., Plexiglass) is a minimum of 6 feet above the stage floor between the live entertainer and customers;
- When present, all wind-blown instruments must have a bell covering or be in an instrument bag when not in use;
- All customers must refrain from cheering or singing along;
- Cleaning and disinfecting of all surfaces must be conducted pursuant to CDC disinfection criteria between each live entertainment from different performers; and
- Sharing of microphones, props, and other items used for performances are prohibited, unless they are properly cleaned and disinfected between uses by different individuals.
- Movie theaters and food concession sales; provided, the following requirements are met:
- Must not exceed 75% of the occupancy load;
- Face masks are worn at all times by customers (and employees), except when actively eating and drinking;
- Designated movie attendant is assigned to each auditorium to ensure compliance by customers;
- The food concession adherences to the Guam Food Code and DPHSS Guidance Memo 2021-07 (REV 1);
- Communal food and condiments that requires shared serving utensils or equipment are eliminated;
- Barriers between employees and customers are provided at service counter or point of sale; and
- A written record is maintained by the establishment, which provides the following information that must be readily available to DPHSS, when requested:
- Date and time of the visit of every customer;
- Name of customer(s);
- Customer’s seating area;
- Number of customers in each auditorium; and
- Phone and/or email of every customer.
- Organized Sports, Non-Contact and Contact Training and Competition; provided:
- Spectators shall be limited to four (4) per athlete (referenced as a spectator pod). Each spectator pod must be seated at least six (6) feet from the next spectator pod. Spectators shall be required to wear face masks at all times.
- All athletes must wear face masks at all times when not actively participating in athletic activity;
- Non-participants, such as instructors, employees, and parents must wear face masks at all times;
- Athletes must maintain 6 feet separation from others when not in the field of play or when engaged in play/activity, whenever possible;
- Coaches, officials, and individuals who are not from the same household must maintain at least 6 feet social distancing from other individuals;
- Athletes and coaches are encouraged to avoid high fives, handshakes, fist bumps, or hugs;
- When handwashing stations are not available, there must be a sufficient supply of hand sanitizer with at least 60% alcohol available for use;
- Clean and disinfect highly touched surfaces, equipment, gear, and shared objects and equipment between each use;
- Conduct detailed cleaning and disinfection of the entire athletic facility, including chairs, furniture in meeting rooms, locker rooms, bathrooms, and athletic training room tables, daily when in use using disinfectant cleaning supplies; and
- All persons are prohibited from congregating in the parking lot or near the field, gym, or sports complex/facility before and after games.
- Outdoor Dining in an Eating and Drinking Establishment; provided each party is at least 6 feet away from the other party. The outdoor dining area may be covered to protect from the elements but shall not be enclosed by more than two sides.
- Outdoor, non-contact, recreational activities, such as golf, tennis, shooting, scuba diving is authorized; provided, the following are implemented:
- Social distancing of not less than 6 feet is maintained;
- Face mask is worn whenever possible;
- Group activities cannot exceed one hundred (100) individuals; and
- Paddling sports (kayaking, stand up paddling) are limited to no more than six (6) persons.
- Dancing; provided, face masks are worn by all participants, and they maintain 6 feet physical distancing if not from Immediate Family Unit or Single Household Unit.
- Religious activities and Places of Worship are authorized, provided:
- Participants adhere to DPHSS Guidance Memorandum 2020-040 REV 1 (Minimum Requirements for Places of Worship), unless otherwise provided herein;
- Must submit facility mitigation plan to DPHSS;
- For funeral ceremonies, both religious and non-religious, that are held indoors must not exceed 75% of the occupancy load, and for associated activities (i.e., burial) held outdoors, it must not exceed 100 individuals and all must wear face masks and maintain 6 feet distancing; and
- Services involving the administration of sacraments or celebration of high holy days are permitted, but must be limited to 75% occupancy load, including the clergy, minister, or other religious leader and his/her assistant, if necessary.
- Effective July 1, 2021, Senior Citizens Centers and Adult Group Day Care Centers may operate; provided, the participants and operators adhere to all applicable provisions of DPHSS Guidance memoranda, including:
- Practicing physical distancing and wearing of face mask;
- Arrangement of tables and chairs to allow for physical distancing of 6 feet apart with placement of visual cues, such as tape or chalk to guide spacing;
- Controlling and limiting non-essential visitors;
- Installation of physical barriers in areas where social distancing is not possible or difficult;
- Displaying of visual posters for 6 feet social distancing, wearing of face mask, and monitoring of COVID-19 symptoms;
- Limiting or eliminating non-essential services and activities that promote transmission of the COVID-19 virus;
- Maintenance of daily log with contact information of all staff and participants of the facility;
- Frequent washing of hands using soap, water, and sanitary paper towel, or use of hand-sanitizer;
- Cleaning and disinfecting of surfaces before and after use, especially high-touch surfaces; and
- Not exceed 75% of the facility’s occupancy load.
- Swimming pools, private and public, at 75% of the pool’s occupancy load is authorized, and the operator:
- Adheres to DPHSS Guidance Memorandum 2020-17 (Minimum Requirements for Operations of Swimming Pools and Waterparks) except the reference to DPHSS Guidance Memorandum 2020-12; and
- Prohibits the congregation of more than one hundred (100) individuals per group at poolside and each remain 6 feet distance from one another if not from Immediate Family Unit or Single Household Unit.
- The following; provided, it is limited to no more than one hundred (100) persons per party and the allowable occupancy load is not exceeded, if applicable:
- Aquariums, museums, and zoos;
- Government of Guam parks and beaches;
- Recreational boating and boat charters where 6 feet distancing can be maintained by everyone on board;
- Running, walking, biking, and other recreation and non-contact exercise on public roadways, beaches, and parks;
- Tourist attraction sites and venues; and
- Waterparks and other recreational water venues.
- All businesses that require a written record must maintain this record for a period of 30 days from the date of service and must be readily available to DPHSS, when requested.
Businesses and Services Not Authorized for On-Site Operations.
- Reservations to celebrate public and private functions (i.e., anniversaries, birthdays, weddings, graduations) at Eating and Drinking Establishments and other public venues where the total number of guests exceed one hundred (100) individuals; and
- Other businesses and services not identified by the DPHSS in this memorandum.
